The Non-enforceable Assurance Offers Minimal Security. As discussed above, courts rarely consider such assurances as binding, even if defendants suffer serious consequences from their use. Trump could change his term at any time or only enforce it against companies that fall out of political favor, and a future government would likely take advantage of the five-year statute of limitations, regardless of Trump's position.

On the contrary, Trump's assurance may be worth little in the future, especially for a court—and the financial consequences of non-enforcement could be severe, even for a company like Apple's stature.
