The temporary ban of TikTok for US users may have been short-lived, but the app is still not available in the iPhone App Store. Here's why an attorney says that Apple cannot bring it back again.

Unforced insurance will not provide much guarantee in the decision of the App Store to TikTok.

If you have TikTok on your iPhone, the app now works after a brief period of darkness last Saturday night and during Sunday in the US.

However, if you haven't downloaded it yet, there is currently no way to get the app in the US.

Apple removed it from the App Store because of its "duty to follow laws in territories where it operates."

President Trump assured technology companies that the law banning TikTok would not be applied, which was the impetus for which the American host Oracle restored services on Sunday.

However, a tech lawyer explains why Apple should not follow this example and restore the app to the App Store.

The promise of non-enforcement offers minimal security. As discussed above, courts often treat these promises as non-binding, even when defenders face serious consequences from supporting them. Trump could change his mind at any time or apply the law only to companies that fall from political favor, and a future administration, exploiting the statute of limitations of five years, would be almost certain to pursue violations regardless of Trump's opinion.

In other words, Trump's guarantees may not be very useful in the future, especially for a court - and the financial consequences of non-enforcement could be severe, even for an Apple-sized company.

The full text of Rozenshtein explains the context and history behind the ignorance of unenforceable guarantees in legal cases, and it is equally interesting to read if you wonder why Apple has so far refused to restore TikTok.
