To resolve this issue, the company is now asking the court for an emergency order, requesting that the ban not take effect until the final appeal is heard. The Guardian summarized the claims made in the filing.

“In their filing to the Supreme Court, they state, 'The First Amendment gives them the right to make their choice freely, given that Americans were properly notified of the potential risks of 'hidden' content manipulation, even though they still had the freedom to choose to view content on TikTok.'”

“And if the persistence of the opposite polarity of the direct circuit is established, Congress can retain the freedom to prohibit speech by identifying someone who may be at risk of being influenced by a foreign entity. This includes identifying someone based on the possibility that their speech may be affected by a foreign entity.’”

The company stated that if TikTok were to close for a month, it would lose about one-third of US users, lose advertising clients, and lose the ability to hire content creators and employees with talent.

“TikTok, which considers itself one of the most important speech platforms in the US, claims that it is not an immediate threat to US international security, but that delaying the implementation of the law will allow the Supreme Court to review the legality of the regulation and for the government that took office after Donald Trump to evaluate the law.”

There is a report that Trump met with TikTok's CEO.

Although it was initially threatened and not implemented, it later completely turned around and promised to save the company's top management. Trump was scheduled to meet with the company's top management on the same day, according to NBC News.
